101 Data Inc agrees to provide the Buyer with access to data (“Data”) with the following restrictions:

2. Usage Restrictions:

The Buyer agrees to use the Data solely for the intended purpose as described in Section 3 and in compliance with all applicable laws and regulations, including but not limited to anti-spam laws, privacy laws, and data protection laws.

3. Intended Use:

The Buyer intends to use the Data for legitimate purposes, which may include reaching out to individuals via email addresses and contact information provided with legitimate interest about services that could benefit the addressees.

4. Compliance with Laws:

The Buyer shall ensure that its use of the Data complies with all applicable laws and regulations related to data protection, privacy, and email marketing, including but not limited to the CAN-SPAM Act and GDPR.

5. Opt-In and Opt-Out Mechanisms:

The Buyer shall provide clear and easy-to-use opt-in and opt-out mechanisms for individuals whose data is included in the Data. These mechanisms should allow individuals to subscribe or unsubscribe from further communications.

6. Data Security:

The Buyer agrees to implement and maintain appropriate data security measures to protect the Data from unauthorized access, disclosure, or data breaches.

7. Complaint Handling:

The Buyer shall promptly address and resolve any complaints or concerns raised by individuals on the Data list.

8. Monitoring and Auditing:

101 Data Inc reserves the right to monitor and audit the Buyer’s compliance with this Agreement. The Buyer shall cooperate with any reasonable requests for information related to compliance.

9. Liability and Penalties:

In the event of a breach of this Agreement by the Buyer, 101 Data Inc may seek remedies, including but not limited to financial penalties and contract termination.

10. Termination:

This Agreement may be terminated by either party for any reason by providing written notice to the other party. In the event of termination, the Buyer shall promptly cease using the Data.
101 Data Inc reserves the right to remove access for users of the platform that abuse the policies.
